Terms of Sale

These Terms of Sale (the "Terms") apply when you buy OSMA products on the English version of our website (pages under /en/) for delivery in the United States. They are a contract between you and Skolt Art LLC, a Wyoming limited liability company ("OSMA", "we", "us" or "our"). Please read them before you order. By placing an order, you accept them.

In short: you must be at least 18 years old with a US delivery address, prices are in US dollars with import duties included, shipping is a flat $5.95 per order, and unused, unopened items can be returned within 30 days of delivery. These Terms do not require arbitration and do not take away your right to go to court or to join a class action.

1. Who we are

OSMA is a brand of Skolt Art LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States, Wyoming filing number 2026-002102300. Email: skoltartllc@outlook.com. Full details are on our Seller Information page.

Orders delivered in Japan are sold on our Japanese website, in Japanese yen, under separate Japanese terms (利用規約).

2. Who can buy

• You must be at least 18 years old and able to enter into a binding contract.
• Orders placed on this website can only be delivered to addresses in all 50 US states and Washington, D.C., as described in our Shipping policy.
• We sell to individual customers, for their own use or as a gift, not for resale. We may limit the quantity of a product per order.
• Please give us accurate contact and delivery details. We use them to deliver your order and to reach you about it.

3. Our products

• Product information: each product page shows what is in the box, how to use the product, its scent notes and its materials. Please read it, and our Product Safety page, before you order.
• Glass: each glass piece can differ slightly. A small bubble, a faint line or ripple, or a slight difference in shape, size, thickness or tint from the photos is normal. It is not a defect. A crack, a chip or a sharp edge is a defect, and Section 10 applies.
• Marble, ceramic and wood: veining, glaze and grain also vary from one piece to the next.
• Scent: how a scent comes across depends on the room, the air, the temperature and your own sense of smell. The tint of oils, reed diffuser liquid, melts and cones can also vary slightly from batch to batch.
• Photos: we photograph our products as faithfully as we can, but colors look different from one screen to another. Furniture and other props in our photos are not included.
• Electric items: the Wax Warmer has a type A plug for 100 to 120 V outlets, the standard in the United States. The Dial Diffuser runs on a rechargeable battery and charges by USB-C.
• Purpose: our products are made to scent a room. They are not cosmetics, are not for use on the body and are not toys.

4. Prices, sales tax and duties

• All prices are in US dollars (USD). Each product has one price, shown on its product page.
• Prices do not include sales tax. Where the law of the state you ship to requires us to collect sales tax on your order, we calculate it from your delivery address and show it at checkout before you pay.
• We do not collect sales tax in every state. Where we do not, your purchase may still be subject to use tax in your state, unless it is exempt. Your state's tax department can tell you more.
• Import duties and customs fees are paid by us. If a carrier ever asks you for any, contact us and we will cover it in full.
• We may change our prices at any time. The price that applies to your order is the one shown at checkout when you place it.
• If a price or a product description on our website is clearly wrong, we may cancel the affected order before it ships. We will tell you and refund everything you paid.

5. Orders

• Online payment is being set up. Until it opens, no order can be placed and nothing can be charged on this website. These Terms apply to every order placed once it opens.
• Before you pay, the checkout page shows each item, its quantity and price, the shipping fee, the total before sales tax, how any sales tax is added, and the estimated delivery, with links to these Terms and our policies. Please check them carefully.
• Placing an order is an offer to buy. We email you an order confirmation once your payment is authorized. Your order is accepted, and the contract between us is formed, when we send that email.
• We may decline or cancel an order before it ships if we suspect fraud, cannot verify the payment, cannot deliver to the address given, or if a product becomes unavailable. If we do, we will tell you and refund everything you paid within 5 to 10 business days.

6. Payment

• When online payment opens, you will be able to pay with: Credit and debit cards (Visa, Mastercard, American Express, JCB), Apple Pay and Google Pay.
• Your payment method is charged when you place your order. Every order is a one-time purchase. We do not sell subscriptions and we never charge you again automatically.
• Payments are processed by our third-party payment provider. We never see or store your full card number.
• By placing an order, you confirm that you are authorized to use the payment method you provide.

7. Shipping and delivery

• Shipping is a flat $5.95 per order. You pay it once per order, whatever the order contains.
• We ship your order from our partner warehouse overseas within 1 to 3 business days after it is confirmed. Transit then takes 7 to 12 business days, so most orders arrive about 8 to 15 business days from order confirmation. Delivery dates are estimates.
• If we cannot ship within the time stated, we will tell you before that time runs out and give you the choice to accept the delay or cancel for a full refund, as the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule requires. See Shipping delays.
• Ownership of the products, and the risk of loss, pass to you when the carrier delivers your order to the address you gave us. If a package is lost or damaged before delivery, we replace or refund it.

8. Canceling an order

You can cancel your order at any time until it ships by emailing us with your order number. We refund the full amount, including shipping, within 5 to 10 business days. Once your order has shipped, it can no longer be canceled, but you can return eligible items under Section 9.

9. Returns and refunds

Unused, unopened items can be returned within 30 days of delivery. Fragrance oils and reed diffusers that have been opened, cones that have been burned and melts that have been used cannot be returned, unless they are defective or not what you ordered. Return shipping is paid by you, unless the item is defective, damaged or wrong. Refunds go to your original payment method within 5 to 10 business days after we receive the return. Full details are in our Returns & Refunds policy, which is part of these Terms.

10. Limited warranty: broken, damaged, defective or wrong items

This is our limited warranty. It applies to every product you buy from us on this website, for you as the buyer.

• What it covers: an item that arrives broken or damaged, including cracked or chipped glass; an item with a defect in materials or workmanship, such as a leaking bottle, a missing part or an electric item that does not work when first used as instructed; and an item that is not what you ordered.
• How long: this limited warranty lasts 30 days from delivery. Please contact us as soon as you notice a problem; for glass broken in transit, the sooner the better.
• What we do: we send you a replacement, subject to availability, or give you a full refund of the item, as you prefer, together with the shipping fee you paid. You do not need to send broken glass back. If we need another item back, we pay for the return shipping.
• What it does not cover: the slight variations of glass, marble, ceramic and wood described in Section 3; normal wear; and damage caused by using a product against its instructions, for example heating an empty glass vessel, pouring cold water onto hot glass, using a melt with a flame or connecting an electric item to the wrong voltage.
• How to claim: email skoltartllc@outlook.com with your order number, a short description and photos of the item, the packaging and the shipping label. The warrantor is Skolt Art LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. It is in addition to the implied warranties described in Section 11, and it does not shorten them. If a problem appears more than 30 days after delivery, please contact us anyway: the implied warranties of your state may still apply.

11. Implied warranties

Every product you buy from us comes with the implied warranties that the law of your state gives you and that cannot be excluded, such as the implied warranty of merchantability (that a product is fit for the ordinary purpose for which it is used). We do not disclaim them and we do not limit how long they last. Nothing in these Terms takes away any warranty right that the law gives you.

Separately from the products you buy, the website itself and its general content are provided "as is", to the extent the law allows. We work to keep it accurate and available, and we correct errors when we find them.

12. Using our products safely

Our products involve flame, heat, electricity and concentrated fragrance. Please follow the instructions in the box, on the label and on our Product Safety page. In particular:

• never leave a tea light or a burning cone unattended, and keep flames away from children, pets and anything that can catch fire;
• fragrance oils, reed diffuser liquid and melts are not for use on skin and must never be swallowed;
• use electric items indoors only, on 100 to 120 V, and unplug them after use.

13. Limitation of liability

Nothing in these Terms limits or excludes our liability where the law does not allow it, such as liability for personal injury or property damage caused by a defective product, or for our gross negligence, fraud or willful misconduct. Nothing in them limits your rights under the consumer protection and implied warranty laws of your state either.

Subject to that, and only to the extent permitted by law:

• we are not liable for indirect, incidental, special or consequential damages arising out of or relating to these Terms, the website or the products you buy from us; and
• our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. If you live in New Jersey, this section applies only to the extent permitted by New Jersey law.

14. Governing law and where claims are heard

These Terms, and any dispute about them or about an order, are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. This choice of law does not deprive you of the protection of any law of your state of residence that cannot be waived by agreement.

You may bring a claim in any court that has jurisdiction where you live, including small claims court, or in the courts of Sheridan County, Wyoming. If we ever need to bring a claim against you, we will bring it in the courts of the county where you live.

15. Resolving a problem

Most problems are settled quickly by email. If something has gone wrong, write to us at skoltartllc@outlook.com with your order number, what happened and what you would like us to do. We reply within 2 business days.

• Informal resolution first: before either of us starts a court case about a dispute relating to these Terms or an order, the one who has the dispute sends the other a short written description of it: you to our email address, we to the email address used for your order. We then both try in good faith to settle it for 30 days after it is received. Any time limit for bringing the claim is paused during those 30 days, to the extent the law allows.
• Government agencies: nothing in this section stops you from contacting a government agency at any time, such as your state Attorney General or the Federal Trade Commission.
• No arbitration and no class action waiver: these Terms do not require arbitration. If we cannot settle a dispute, either of us may go to court as described in Section 14, and nothing in these Terms takes away your right to bring or join a class action.

16. Notice for California users

Under California Civil Code Section 1789.3, California users of this website are entitled to the following consumer rights notice. This website is provided by Skolt Art LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States, email skoltartllc@outlook.com. There is no charge for using the website itself. The prices of our products and shipping are shown on the website and at checkout. To resolve a complaint about the website or an order, please contact us by email first. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

17. Using our website

• You may use this website for your personal, non-commercial use.
• Please do not misuse it: for example, do not copy or scrape its content in bulk, interfere with its operation or security, upload malicious code, place fraudulent orders or use it for any unlawful purpose.
• The OSMA name and logo, the website design, and its text, photos and graphics belong to Skolt Art LLC or its licensors and are protected by intellectual property laws.
• Links to other websites are provided for convenience. We are not responsible for their content or practices.
• How we handle personal information is explained in our Privacy Policy and Cookie Policy.

18. Emails from us

You agree that we may send you order confirmations, shipping notices, delay notices and other information about your order by email, and that these emails meet any legal requirement for such communications to be in writing.

19. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as storms, floods, fires, carrier disruptions or customs delays. Even then, we will tell you about any shipping delay and give you the choice to cancel for a full refund, as described in Section 7.

20. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new "last updated" date. The version posted when you place an order applies to that order.

21. General

• Entire agreement: these Terms, together with our Shipping, Returns & Refunds, Product Safety, Privacy and Cookie policies, are the entire agreement between you and us about your purchases on this website.
• Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver: if we do not enforce a provision right away, we can still enforce it later.
• Transfer: we may transfer our rights and obligations under these Terms to a company that takes over our business, and your rights will not be reduced. You may not transfer your rights without our written consent.
• Headings: headings are for convenience only.
